Joimo Kombucha LLC (“Joimo, and sometimes referred to as “we,” “us,” and “our”) understands the importance of protecting your personal information. This privacy policy (“Policy”) describes the types of information we may collect from you or that you may provide when you use this website or other applications, products, and services we provide that link to this policy (collectively, the “Platform”), our practices regarding collection, use, maintenance, protection, and disclosure of your personal information, and how we will treat it.

This Policy applies only to information we collect through the Platform, in communications, including email, text, chat, and other electronic messages, between you and the Platform, and potentially when you interact with our advertising and applications (including mobile apps) on third-party websites and services, if those applications or advertising include links to this policy. This Policy does not apply to information collected by: us offline or through any other means, including on any other website operated by us or any third party that does not link to this policy; or any third party including through any application or content (including advertising) that may link to or be accessible from or through the Platform.

Please read this Policy carefully to understand our policies and practices regarding your information and how we treat it. By interacting with our Services or providing us with your information, you agree to the collection, use, and sharing of your information as described in this Policy. We may change this Policy at any time or from time to time. If we make any material changes to this Policy, we will notify you by posting an announcement on the Platform, emailing or texting you a notice, or by other appropriate means of communication. Your continued use of our Platform after we make changes is deemed to be acceptance of those changes, so please check the Policy periodically for updates.

Information We May Collect About You and How We Collect It

We may collect information about you when you interact with the Platform, such as when you create or update an account, place an order, subscribe, make a purchase or request, participate in surveys, sweepstakes, contests, or promotions, or create, upload, or post content to the Platform, including reviews, media such as photos, videos, or audio recordings.

We may collect several types of personally identifiable information from and about you including information that identifies, relates to, or describes, directly or indirectly, you as an individual, such as your name, email address, telephone number, home, mailing and billing address, account name, IP address, payment information including bank account or credit card number, and other identifiers we may use to contact you. Collectively, the information described above and any other personally identifying information we may collect from you shall be referred to as “personal information.”

Account and contact information, including name, address (such as home address, work address, or other address), email address, phone number, username, and other contact information you provide us.
Payment information, including credit card or debit card information and information about the payment methods and services (such as PayPal or Venmo) you use in connection with the Platform.
Account history, including information about your subscription, account, transactions, purchases, order history, or discounts.
Demographic information, including your age, gender, income level, education, or family or marital status, if you have consented to such information collection.
Location information, including general geographic location such as country, state or province, or city and precise geolocation, if you have enabled and consented to location information collection.
Device information, including your IP address, device identifiers, operating system and version, preferred language, hardware identifiers, browser type and settings, and other device information.
Content and information you elect to provide as part of your profile or in any reviews you make through the Platform or emails, chats, or other communications sent to us.

We may collect personal information:

Directly from you if and when you provide it to us, including through the contact page on the Platform, if you create an account with us, when you register or interact with the Platform, through e-mail and subscription services, or if you order a product from us; and
Automatically as you navigate through our Platform through cookies and other automatic forms of data collection. Personal information collected automatically may include usage details, IP addresses and other information collected through automatic processes.

We ask that you do not send us or disclose any sensitive personal information on or through the Platform or otherwise. Such sensitive information includes racial or ethnic origin, religion or other beliefs, political opinions, health, criminal background or trade union membership.

Information We Collect through Automatic Data Collection Technologies

As you navigate through and interact with the Platform, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions and patterns, including:

Details of your visits to the Platform, including usage details, traffic data, logs and other communication data and the resources that you access and use on the Platform; and
Information about your computer, mobile device and internet connection, including your IP address, operating system, and browser type.

The information we collect automatically is intended to be statistical data and may include personal information. It helps us improve the Platform, deliver a better and more personalized service, and ensure the Platform is secure and safe to use.

The technologies we use for this automatic data collection may include cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer. Cookies can be used to store a unique identification number tied to your device so you can be recognized as the same user across multiple browsing sessions and multiple websites. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of the Platform. Unless you have adjusted your browser setting so that it will refuse cookies, we will issue cookies when you direct your browser to the Platform.

The Platform also uses the Facebook pixel, which is code that collects data that will help us track interactions with our Facebook advertisements and allow us to target and optimize Facebook advertisements for users that have visited the Platform and are also logged into their Facebook accounts. The data collected is cookie-based and is anonymized meaning it does not allow us to draw conclusions about the identity of the users. The data is stored and processed directly by Facebook. Facebook data processing is governed by Facebook’s Data Policy, which can be found at https://www.facebook.com/policy.php. You can set your ad preferences or opt out of Facebook targeting directly under your Facebook account settings, at https://www.facebook.com/adpreferences/ad_settings/.

California Business & Professions Code Section 22575(b) provides that California residents are entitled to know how we respond to “Do Not Track” browser settings or signals. We do not currently take actions to respond to “Do Not Track” signals. It is our view that a uniform technological standard has not yet been developed. We may adopt a standard once one is created.

Information We Collect from Third Party Sources

We may also collect information about you from publicly and commercially available sources, as permitted by law, which we may combine with other information we receive from or about you. An example of a publicly and commercially available source would be your social media accounts and all information associated with such accounts if you connect to the Platform through such accounts.

Information Collected by Third Party Sources

When you interact with the Platform, third parties may use automatic collection technologies to collect information about your or your device. These third parties may include:

Advertisers, ad networks, and ad servers.
Analytics companies.
Your device manufacturer.
Your internet or mobile service provider.

These third parties may use tracking technologies to collect information about you when you use the Platform. The information they collect may be associated with your personal information or they may collect information about your online activities over time and across different websites, apps, platforms, and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content. We do not control these third parties’ tracking technologies or how they may be used. For example, we may obtain information about you from service providers that we engage to perform services on our behalf, such as email platform providers, content delivery services, payment processors, promotions services, gift card program providers, analytics, security and anti-fraud services, and data brokers. We also may receive personal data from business partners that we engage to share consumer information with us, including your personal preferences and demographic information such as age, gender, and income level so that we can better provide you with a personalized experience, including personalized content, offers and services.

How We Use Your Personal Information

If you do not want us to use your information in this way, please do not sign up for our subscription services. If you have already received e-mails through our subscription services, and you wish to discontinue the services, you may e-mail us at hello@joimotea.com stating your request.

The usage information we collect, whether connected to your personal data or not, helps us improve our Platform and deliver a better and more personalized experience by enabling us to:

Estimate our audience sizes and usage patterns.

Access or Update Your Information

You can access or modify your account with us on the account page. Even after you cancel your account or ask us to delete your personal information, copies of some information from your account may still be viewable if, for example, you have shared information with other services such as social media. Your account may not be instantly inaccessible to others due to the nature of caching technology. Additionally, we may retain information related to your account after cancellation or your request for deletion to comply with legal requirements, for our internal security or recordkeeping, or for fraud detection. We may not be able to completely delete all of your personal information due to financial, contractual or legal requirements, or technical constraints.

California Civil Code Section §1798.83 permits users of the Platform that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes, if applicable. California Consumer Privacy Act of 2018

The California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (collectively, the “CCPA”) provides certain consumers with specific rights regarding their personal information. Currently, we do not constitute a “business” as defined and covered under the CCPA. Should that determination change at any time, we will update this Policy, accordingly.

Depending on your state of residency and whether we qualify as a covered business under that state’s laws and regulations, you may have certain rights related to your personal information, including:

Access and Data Portability. You may confirm whether we process your personal information and access a copy of the personal information we process. To the extent feasible and required by state law, depending on your state, personal information will be provided in a portable format. Depending on your state, you may have the right to receive additional information and it will be included in the response to your access request.
Correction. You may request that we correct inaccuracies in your personal information that we maintain, taking into account the information’s nature and processing purpose.

Children’s Privacy

Our services are not directed to, and we do not knowingly collect personal information from children under the age of 13. If we receive personal information that we discover was provided by a child under the age of 13, we will promptly destroy the information. We recommend that parents actively participate in their children’s use of the Internet.

Data Security

Unfortunately, the transmission of information via the internet is not completely secure. Although we implement reasonable measures to protect your personal information, we cannot guarantee the security of your personal information transmitted to the Platform, or thereafter. Any transmission of personal information is at your own risk. It is important for you to protect against unauthorized access to your password and to your computer or mobile device. How We Use Cookies and Similar Technologies

The Platform and third parties that provide content, advertising or functionality, or analyze advertising performance on the Platform may use cookies, mobile ad identifiers, web beacons and similar technologies to improve the Platform, determine or improve the advertising shown to you here or elsewhere, to provide you with a personalized experience, or to facilitate administration and navigation of the Platform. You can set your browser to refuse all or some browser cookies or other tracking technology files, or to alert you when these files are being sent. You can choose whether or not to allow the Platform to collect information through other tracking technologies. If you disable or refuse cookies or similar tracking files, some Platform features may be inaccessible or not function properly.
